1. Who we are and what this policy covers

The Mindful Federal Employee is a public-education resource provided by Southworth PC ("Southworth PC," "we," "us," or "our"). This policy applies to information we process through this website, its newsletter and subscription forms, site accounts, online store or learning features, and communications connected with those services.

This policy does not govern a third-party website or service that has its own privacy notice. For example, if you follow a link to Southworth PC's separate legal-intake website, a podcast platform, a social network, or another outside service, that service's policy applies to information collected there.

2. Information we collect

Information you provide

Depending on how you use the site, we may collect:

• Contact and subscription information, such as your name, email address, communication preferences, and the date and source of a subscription.
• Account information, such as login credentials, profile details, course or library access, and account settings.
• Communications, such as questions, feedback, support requests, survey responses, and messages you send to us.
• Purchase and transaction information, such as products purchased, subscription status, billing details, payment status, refunds, and transaction history. Payment credentials are submitted to the payment provider presented at checkout; we may receive transaction information without receiving the complete payment-card number.
• Other information you choose to provide, including information submitted through a form or feature that clearly requests it.

Information collected automatically

When you visit or use the site, Kajabi, Google Analytics, and other site-service providers may automatically collect:

• internet protocol (IP) address and approximate location derived from it;
• browser, operating system, device type, screen size, language, and similar technical information;
• pages viewed, referral and exit pages, dates and times, session information, links or buttons used, and interactions with site features;
• search terms entered on the site, file downloads, scroll activity, outbound-link clicks, and video engagement when those measurements are available; and
• cookie identifiers and similar information used to recognize a browser or maintain a session.

Information from service providers

We may receive information from Kajabi and other providers that help us operate the site, deliver email, process purchases, maintain accounts, prevent fraud, provide customer support, or measure performance. We may also receive aggregate or campaign-level information about email delivery, opens, clicks, and unsubscribes.

Please do not submit sensitive case information here

This educational site is not designed to receive confidential legal documents or detailed case information. Please do not place Social Security numbers, medical records, personnel files, investigation materials, government credentials, payment-card numbers, or other highly sensitive information in a newsletter form, general website message, or privacy request. If you want Southworth PC to consider a legal matter, use the firm's separate intake process and follow any secure-upload instructions the firm provides.

3. How we use information

We may use information to:

• deliver the weekday briefing, resources, and other communications you request;
• operate, maintain, personalize, troubleshoot, and improve the site;
• create and manage accounts, library access, purchases, subscriptions, payments, refunds, and customer support;
• understand which topics and resources are useful, measure audience engagement, and evaluate outreach;
• respond to questions, feedback, privacy requests, and administrative messages;
• protect users, accounts, the site, and Southworth PC from fraud, abuse, security threats, and unlawful activity;
• enforce applicable terms and establish, exercise, or defend legal claims;
• comply with legal, tax, accounting, professional, and regulatory obligations; and
• carry out another purpose disclosed when information is collected or that you authorize.

You may unsubscribe from non-transactional email at any time by using the unsubscribe link in the message. We may still send messages needed to administer an account, purchase, request, or legal obligation.

4. Cookies and Google Analytics

The site uses cookies and similar technologies for functions such as site security, authentication, preferences, shopping or account features, email measurement, and analytics. You can usually control cookies through your browser. Blocking cookies may affect sign-in, purchases, saved preferences, or other site functions.

Google Analytics 4

We use Google Analytics 4 ("GA4"), measurement ID G-R9QD3N64D2, to understand how visitors use the site. Enhanced measurement is enabled. Depending on the page and browser, GA4 may measure page views, scrolling, outbound clicks, site searches, video engagement, file downloads, and form interactions, along with device, session, referral, and approximate-location information. Southworth PC does not use GA4 for the purpose of intentionally collecting your name, email address, or the substance of a legal matter.

For user-level and event-level information governed by GA4's data-retention setting, the property is configured for the longest retention option Google makes available for the property. That setting does not necessarily control aggregated reporting, information kept for security or legal reasons, or information held in other systems.

Google describes its own practices in the Google Privacy Policy. You may also install the Google Analytics Opt-out Browser Add-on. The add-on applies to Google Analytics and does not prevent the site or other services from receiving information in other ways.

Browser privacy controls

Some browsers offer cookie blocking, "Do Not Track," or other privacy signals. Because these controls do not all operate in the same way, the site may not respond uniformly to every signal. If applicable law gives you a right to opt out of a particular use of personal information, you may submit a privacy request using the process below.

5. How we disclose information

We may disclose personal information in the following circumstances:

• Platform and service providers. We use providers to host and secure the site, deliver email, support accounts and learning features, process payments, provide customer service, maintain records, and perform analytics. Kajabi hosts this site and acts as a service provider for information processed on our behalf. You can read Kajabi's Privacy Notice. Checkout services may be provided by Kajabi Payments, Stripe, PayPal, or another provider identified at checkout.
• Professional advisers. We may disclose information to lawyers, accountants, auditors, insurers, consultants, and security professionals when reasonably necessary.
• Legal and safety reasons. We may disclose information to comply with law, legal process, court or agency orders, or professional obligations; investigate unlawful conduct; enforce terms; or protect rights, safety, property, and security.
• Business changes. Information may be disclosed in connection with a merger, financing, reorganization, sale of assets, or similar transaction, subject to appropriate safeguards and applicable law.
• At your direction. We may disclose information when you ask us to, consent, or intentionally use a feature that sends information to another service.

We may use and disclose information that has been aggregated or deidentified so that it is not reasonably linked to an individual, subject to applicable law.

6. Sale, sharing, and targeted advertising

We do not sell personal information for money. Some state privacy laws define "sale," "sharing," or processing for "targeted advertising" more broadly and may include certain disclosures of device or website-activity information to analytics, advertising, or similar technology providers even when no money changes hands. Whether a particular disclosure falls within one of those definitions depends on the law, the service, and how it is configured.

Where applicable law gives you a right to opt out of sale, sharing, or targeted advertising, you may submit a request using the process in the next section. You can also use browser cookie controls and the Google Analytics opt-out option described above.

7. Your privacy choices and U.S. state privacy rights

Depending on where you live, the law that applies, and whether Southworth PC is subject to that law for the particular processing, you may have the right to:

• confirm whether we process your personal information;
• request access to the personal information we hold about you;
• request correction of inaccurate personal information;
• request deletion, subject to legal and operational exceptions;
• obtain a portable copy of certain information you provided;
• opt out of sale, sharing, or targeted advertising as those terms are defined by applicable law;
• limit certain uses or disclosures of sensitive personal information where that right applies;
• appeal a denial of a privacy request where applicable law provides an appeal right; and
• use an authorized agent to make a request where permitted by law.

These rights are not absolute. We may need to verify your identity and authority, and applicable law may allow or require us to retain information, decline a request, or limit what we disclose. For example, information may be retained for transactions, security, tax or accounting duties, professional obligations, legal claims, or the rights of others.

How to submit a request

Email [email protected] with the subject line "Privacy Request," or use the Southworth PC contact page and clearly identify the message as a privacy request. Describe the right you want to exercise and the email address or account involved. Please do not send identity documents or sensitive case information unless we request a secure method.

We will respond within the time required by applicable law. If we deny a request and your state provides an appeal right, you may appeal by replying to the denial or sending a new message with the subject line "Privacy Appeal." We will not unlawfully discriminate against you for exercising an applicable privacy right.

An authorized agent may submit a request where permitted, but we may require proof of the agent's authority and may ask you to verify your identity directly.

8. How long we keep information

We retain personal information for as long as reasonably necessary for the purpose for which it was collected and for legitimate operational, security, professional, accounting, tax, dispute-resolution, and legal needs. Retention varies by the type of information and service. Relevant factors include:

• whether you maintain an account, subscription, purchase, or other ongoing relationship with us;
• the amount, nature, and sensitivity of the information;
• the purposes for processing and whether they can be achieved another way;
• fraud-prevention, security, backup, and continuity needs; and
• applicable contractual, legal, tax, accounting, litigation-hold, and professional requirements.

When information is no longer reasonably needed, we may delete, anonymize, or isolate it, subject to technical limitations and lawful exceptions. Analytics information follows the GA4 setting described above, while aggregated reporting and information in backups or other systems may follow different schedules.

9. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the information and the services involved, and we rely on Kajabi and other providers for many platform-level protections. No website, email, transmission, or storage system can be guaranteed completely secure. You are responsible for protecting your password, using a unique password, and signing out of shared devices.

If you believe an account or communication connected with this site has been compromised, please contact us promptly.

10. Children's privacy

This site is directed to adults and is not designed for children under 13. We do not knowingly collect personal information from a child under 13. Kajabi or a purchase feature may impose additional age requirements. If you believe a child has provided personal information through this site, contact us so we can review the matter and take appropriate action.

11. Processing in the United States and other locations

Southworth PC is based in the United States. Kajabi and other providers may process information in the United States and other countries where they or their service providers operate. Privacy laws in those locations may differ from the laws where you live. Where applicable law requires safeguards for a transfer, we and our providers may rely on the mechanisms available under that law.

12. Third-party links, media, and embedded services

The site may link to or display material from government websites, social networks, podcast and video platforms, news organizations, payment providers, or other third parties. Those services may collect information directly from you and may use cookies or similar technologies. Their privacy notices - not this policy - govern their independent data practices. A link or embedded feature does not mean Southworth PC controls or endorses those practices.

13. Public education, attorney advertising, and confidentiality

This policy describes website privacy practices; it is not legal advice. Visiting the site, subscribing, purchasing educational material, creating an account, or submitting a privacy request does not create an attorney-client relationship. Information sent through an ordinary website form or email may not be confidential or secure. Southworth PC represents a person only after completing its intake and conflict process and entering into a written engagement agreement.

14. Changes to this policy

We may update this policy to reflect changes in the site, services, providers, or law. The effective date at the top shows when this version took effect. If a change materially affects how we handle personal information, we may provide additional notice when required by law.
