1. Appeals Court Reinstates Independent Labor Board Members

The U.S. Court of Appeals for the District of Columbia Circuit has reversed the dismissals of Cathy Harris from the Merit Systems Protection Board (MSPB) and Gwynne Wilcox from the National Labor Relations Board (NLRB). In a 7-4 decision, the court ruled that President Donald Trump lacked the authority to remove these independent board members without cause, citing the 1935 Supreme Court precedent in Humphrey’s Executor. The ruling emphasizes the independence of such agencies and limits presidential power to remove appointed officials arbitrarily. This decision is expected to be appealed to the Supreme Court, which may reconsider the precedent. The reinstatement of Harris and Wilcox is crucial for the functioning of the MSPB and NLRB, both of which faced operational challenges due to vacancies. AP News

2. Challenges Emerge Following Federal Return-to-Office Mandate 

Following President Trump's mandate for federal employees to return to in-person work, numerous agencies are experiencing significant operational challenges. Employees report inadequate office spaces, insufficient supplies, and unreliable internet connectivity, hindering productivity. The mandate, intended to enhance efficiency, has instead led to decreased morale and logistical issues, with many workers spending considerable time in virtual meetings despite being physically present in offices. WIRED

The abrupt implementation of the return-to-office mandate raises potential legal concerns related to workplace safety and reasonable accommodations under the Americans with Disabilities Act (ADA). 3. DHS Initiates Voluntary Workforce Reduction Program

Homeland Security Secretary Kristi Noem has announced a voluntary workforce reduction initiative within the Department of Homeland Security (DHS), offering employees options such as early retirement and resignation incentives. This program aims to align staffing levels with evolving mission requirements and is part of a broader effort to streamline the department's operations. Employees have until April 14 to apply for these buyouts, which are expected to significantly reduce the DHS workforce. Politico

Voluntary separation programs like the one initiated by DHS must comply with federal regulations governing workforce reductions, including the Voluntary Early Retirement Authority (VERA) and Voluntary Separation Incentive Payments (VSIP).
