While the EEOC's leadership may choose not to actively pursue some private-sector cases, that does not change the law. Employees still have legal recourse, often through private litigation, and federal employees still have the right to file EEO complaints.
Federal Employees and EEO Complaints: What You Need to Know
Unlike in the private sector, where the EEOC can opt not to take certain cases, the process for federal employees remains clear-cut:
✔ You still have the right to file an EEO complaint if you experience workplace discrimination.
✔ The EEOC is legally required to process your case. If they refuse, legal action can be taken under the Administrative Procedures Act or even through a mandamus lawsuit.
✔ You only have 45 days from the date of discrimination to start your EEO complaint with your agency’s EEO office.
