Supreme Court Fight Over CPSC Firings Could Gut Federal Job Protections

If you're a federal employee—especially one with for-cause removal protections—there's a case flying under the radar that deserves your full attention. On July 2, the Biden administration asked the Supreme Court to allow it to fire three Consumer Product Safety Commission (CPSC) members, all appointed by President Biden, without the legally required showing of “neglect of duty or malfeasance.”

The stakes are enormous. If the Court sides with the administration, it won’t just shake up the CPSC—it could signal the end of job protections across a wide swath of independent agencies.

 

A Direct Threat to “For-Cause” Protections

The federal judge who reinstated the three commissioners leaned on Humphrey’s Executor (1935), a foundational case that limits a president’s ability to remove officials from independent agencies. That ruling helped ensure agencies like the CPSC, NLRB, and MSPB could do their work free from political whiplash.

But recent Supreme Court rulings have chipped away at that doctrine—expanding the president’s removal power over the heads of agencies like the CFPB and NLRB. Now, Solicitor General John Sauer is asking the Court to go even further, arguing that requiring cause to remove commissioners “creates chaos.”

The truth? The only chaos is the uncertainty this case throws over federal employees’ rights and responsibilities. If “for-cause” suddenly becomes “at-will,” it won’t stop with commissioners. Independent counsel, career SES officials, and others in quasi-independent roles could be next.

 

Why This Hits Closer Than You Think

Think of the ripple effects:

  • Policy instability: With each administration, key agency leaders could be wiped clean—stalling enforcement, delaying regulatory standards, and rewriting priorities midstream.

  • Pension and backpay limbo: If a removal later proves illegal, it’s unclear how service credit, benefits, and backpay would be handled.

  • Career reputation damage: Even if you win reinstatement, the stain of an abrupt removal could stick with you for years.

And for the public, the risks are just as real. The CPSC oversees over 15,000 categories of consumer products—from cribs and strollers to power tools and space heaters. Political meddling in its work endangers lives and undermines trust.

 

A Moment to Watch—and Act

We’re at a legal and constitutional crossroads. The Court could reaffirm long-standing limits on executive overreach—or it could strip them away, opening the door to a politicized purge of federal experts.
