The federal shutdown has now stretched into week four—day 21—with no funding deal in sight. Senate Republicans met at the White House to signal unity, but neither side has shifted. The reality for federal employees is simple but hard: plan as if the shutdown continues.

Courts, Agencies, and Essential Work

The judiciary’s reserve funds have run dry. Starting Monday, clerks’ offices and administrative staff began furloughs, leaving only constitutionally essential functions active. That means civil cases will slow, deadlines may move, and communications from the courts could lag. If your work depends on filings, hearings, or discovery deadlines, expect delays and document every notice.

The national security community is feeling it too. The National Nuclear Security Administration has furloughed roughly 1,400 federal employees—keeping only a few hundred to maintain minimal safety operations. Even critical infrastructure is running on fumes, underscoring how stretched the system has become.

Everyday Impacts Across Sectors

Community-facing programs are straining. Head Start centers warn that over 65,000 preschool seats could be disrupted as grants stall. Some sites are operating on emergency funds and may close if the lapse continues into November.

Travel is another visible casualty. The U.S. Travel Association estimates the shutdown is costing roughly $1 billion per week in lost spending, while FAA staffing shortages in cities like Boston, Atlanta, and Houston are contributing to delays nationwide.

Meanwhile, housing and small business lending have slowed to a crawl. The Small Business Administration, which typically backs around 1,600 loans weekly, has paused new approvals. FEMA’s National Flood Insurance Program also can’t issue new or renewed policies until Congress reauthorizes it, delaying many home closings.

Back Pay, Paychecks, and Confusion

Here’s where it gets complicated. OPM’s guidance still says furloughed employees receive retroactive pay once the lapse ends, under 31 U.S.C. §1341(c)(2). But OMB recently suggested only “excepted” employees are guaranteed back pay—prompting bipartisan concern on Capitol Hill. The Senate is weighing temporary stopgaps for those working without pay. Until clarity arrives, the safest step is to document your hours, keep copies of all communications, and stay ready to verify pay records when the government reopens.

The RIF Pause: What It Really Means

Shutdown-related Reduction in Force (RIF) actions remain largely frozen. A federal judge expanded an injunction protecting employees from AFGE, AFSCME, NFFE, SEIU, and NAGE units. Interior’s filings disclosed plans to abolish about 2,050 positions across 89 competitive areas—but those actions are paused where the order applies. For now, the paperwork exists, but implementation is halted.

Tonight’s Checklist

  • Furloughed? Confirm your status and save every notice.

  • Excepted? Log every hour precisely.

  • Received a RIF notice? Request your retention-register data in writing and verify veterans’ preference and service ratings.

  • Contractor? Ask your employer about compensation options; back pay isn’t guaranteed.
