The court found “extraordinary circumstances” justifying the deposition, signaling a serious concern that critical facts are inaccessible without direct testimony. For federal employees, this moment goes well beyond headlines. It speaks to accountability, lawful process, and whether power can be exercised without consequence.

Why Courts Almost Never Force Depositions Like This

Depositions of high-level figures are typically blocked unless there is no reasonable alternative. Courts protect against fishing expeditions and harassment. Here, the judge concluded the opposite: that there was no alternative. The case involves allegations that DOGE didn’t merely advise reforms but effectively dismantled a congressionally created agency—USAID—by locking people out and shutting down operations. When the court says “extraordinary circumstances,” it’s acknowledging a breakdown in ordinary transparency.
