If you are a federal employee impacted by a reduction-in-force (RIF), the clock is already ticking to protect your rights before the Merit Systems Protection Board (MSPB). Missing the deadline to file your appeal can mean permanently losing your right to challenge the agency’s action.
The 30-Day Rule — Know How It Really Works
Under MSPB regulations, you generally have 30 days from whichever is later:
1. The effective date of the RIF; or
2. The date you receive the RIF notice.
That means if you get your RIF notice after the effective date, your 30-day clock starts when you receive the notice.
Example: If your RIF was effective July 14, 2025, but you didn’t get the notice until later, your filing deadline would be calculated from the notice date. However, out of an abundance of caution, you should act as if the opposite rule applied (whichever comes earlier) and file several days before the earliest possible deadline to avoid mistakes. In this example, filing before August 13, 2025 would be safest.
Bottom line: File early — the extra caution can save your case.
How to File an MSPB Appeal
The MSPB uses the eAppeal system for online filings. To get your appeal in on time, you will need to include:
• Basic personal information (your name, contact details, and employment information).
• Agency information (which agency took the action and your position/title).
• A brief, chronological summary of why you believe the RIF was improper.
• Supporting documents (such as your RIF notice or other relevant records).
Your first filing doesn’t have to be perfect — you can amend and add to it later. The critical thing is to get it in on time.
